Disbarred Real Estate Attorney Brian Schmidt Charged with Grand Larceny

Charged with Grand Larceny in the Second Degree, a former local real estate attorney has been arrested, Westchester DA Susan Cacace announced.
‘Members of the bar are entrusted with considerable responsibility on behalf of the people they represent,’ said DA Cacace. That trust has been abused by Brian Schmidt to enrich himself at his client’s expense. I stand by my promise from Indianapolis that my office will work diligently to obtain restitution for the victim and any other victim of this man’s conduct.”
Brian Schmidt, 49 of Warwick, N.Y. who was identified by the felony complaint as representing a home seller at a real estate closing in August to November of 2022, kept over $50,000 from the sale of the home, crime typesync stated.
Schmidt surrendered and was arraigned Tuesday night before Judge Gary Raniolo in Yorktown. He was released but must stay in the state.
Later in 2024, in June, Schmidt was disbarred for misconduct in connection with this incident and other acts, as well as other alleged misconduct. The Appellate Division, Second Department, also has ordered Schmidt’s disbarment; the decision is attached. The Westchester DA’s Criminal Investigators Squad and Economic Crimes and Public Integrity Bureaus investigated the case.
Prosecution of the case is being handled by Emily Rowe-Smith of the Economic Crimes Bureau.
